1. Introduction
Welcome to Omnisea, operated by BlockFactory Sp. z o.o., a company incorporated under the laws of Poland. By accessing, using, or interacting with Omnisea ("Service"), you agree to comply with and be bound by these Terms of Service ("ToS").
2. Eligibility
- You must be at least 18 years old or meet the age of majority in your jurisdiction to use our services.
- By using our Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
3. Service Description
Omnisea is an NFT Launchpad that enables non-fungible tokens creation and minting.

Blockchain & Contract Risks
Blockchain technology and smart contracts are inherently risky. Errors, bugs, vulnerabilities, or exploits may result in loss of funds, data, or access. Interactions with smart contracts are irreversible. Any unintended transactions or losses cannot be undone.
API Integration Risks
Third-party APIs, RPC providers, Blockchains, Web3 Wallet providers, and other third-party services used by Omnisea may experience downtime, malfunctions, or inaccuracies.
Cryptographic Risks
Transactions rely on cryptographic systems which may be compromised or otherwise fail.
Volatility
Digital assets, including these created using Omnisea services, are volatile. You assume the risk of any financial loss.
5. No Guarantees or Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
We do not guarantee:
- Continuous or uninterrupted access to the Service.
- Accuracy, reliability, or completeness of data.
- Absence of security breaches, bugs, or exploits.
6. User Responsibilities
You are solely responsible for:
- The security of your wallets, private keys, API keys, and credentials.
- Ensuring you understand how blockchain technology and smart contracts function.
- Providing valid, accurate, and up-to-date information.
7. Limitation of Liability
To the maximum extent permitted by law:
BlockFactory Sp. z o.o., its affiliates, directors, employees, or partners shall not be liable for:
- Direct, indirect, incidental, consequential, or punitive damages arising from:
- API errors, blockchain vulnerabilities, hacks, or exploits
- Loss of funds, data, profits, revenue, or other benefits
- Errors, delays, or interruptions in service
8. Indemnification
You agree to indemnify, defend, and hold harmless BlockFactory Sp. z o.o. from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your interaction with blockchain contracts or third-party APIs.
9. Third-Party Services
Our Service may integrate with or provide access to third-party platforms (e.g., RPC providers, wallet providers, etc.). We are not responsible for their functionality, availability, or reliability.
10. Intellectual Property
- All intellectual property rights related to the Service (e.g., trademarks, designs, logos, content) belong to BlockFactory Sp. z o.o. or its licensors.
- You may not reproduce, distribute, or create derivative works without explicit written permission.
11. Account Suspension and Termination
We reserve the right to:
- Suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or applicable laws.
- Take appropriate legal action against misuse or fraud.
12. Force Majeure
We will not be liable for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to acts of God, war, cyber-attacks, system failures, or regulatory actions.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Poland. Any dispute arising out of or related to these Terms will be resolved in the courts of Poland.
14. Dispute Resolution
- Any dispute shall first be attempted to be resolved amicably.
- If no resolution is reached, disputes will be subject to binding arbitration under the rules of the appropriate arbitration body in Poland.
15. Amendments
We reserve the right to modify or update these Terms at any time. Changes will be posted on our website and effective immediately upon posting.
16. Agreement Acknowledgment
By using Omnisea, you acknowledge that you have read, understood, and agree to these Terms of Service.
